Ohio Equipment Appraisers

FAQ

Is appraisal binding in Ohio?

An equipment appraisal is not automatically legally binding in Ohio; whether a lender or court must accept the concluded value depends on what the loan agreement, security agreement, or governing contract says, not on the appraisal document itself.

For equipment appraisal used as loan collateral, the appraisal functions as a valuation tool that supports the lender's underwriting decision. A lender typically relies on the appraised value to set loan-to-value ratios and collateral terms, but it retains discretion over how that figure is used unless the loan documents expressly state the appraisal is binding on both parties. Ohio does not have a statute that makes equipment appraisals automatically enforceable the way it might for certain real estate transactions; equipment collateral valuations fall under the lender's own underwriting policy and the terms negotiated in the security agreement.

What makes an equipment appraisal carry weight, even without automatic binding force, is how defensible the report is. A report prepared in accordance with USPAP (Uniform Standards of Professional Appraisal Practice) gives a lender, borrower, or court confidence that the valuation followed a recognized, standardized methodology rather than an informal estimate. That's typically what a lender is actually asking for when they require an "appraisal" as opposed to a dealer quote or internal estimate.

A few practical points worth knowing:

  • Review your loan or security agreement language before assuming the appraised value is final; binding force comes from contract terms, not the appraisal itself.
  • A USPAP-compliant report is more likely to hold up if the valuation is later disputed or challenged by another party.
  • Lenders generally retain the right to order a second opinion or apply their own policy on top of the appraised value.
